Terms & Conditions

By proceeding with any bookings through 13firstavenue.com.au or affiliated third party sites, you have read and accepted the terms below and agree to adhere to them while in occupation. Failure to pay costs caused by your breach of the terms will be deducted from your bond or provided credit card.

Property Representation - Our website describes the premises, position and furnishings to the best of their ability. No responsibility or refunds for alleged misinterpretation can be accepted.

Arrival & Departure - Check in time is 3.00pm for all bookings. Departure time is 10:00am for all bookings. Late departures, unless pre-approved, will incur a disruption fee of $50.

Security Bond - All properties require a security bond to be paid prior to key collection. Security bonds are refunded after satisfactory inspection of the property, within 7 days of your departure. An increased security bond may be incurred for group bookings at our discretion.

Parties - Strictly no parties or gatherings. Failure to comply will result in immediate eviction. No refund will be paid for unused nights accommodation.

Conditions of Use - Each holiday property is equipped for a specific number of guests. It is against Health & Safety regulations for more persons to occupy a property than there are beds to accommodate them. No mattresses, air beds, tents, caravans, or more cars than the property accommodates are allowed. If a property is reported to be overloaded, the tenants will be asked to vacate with no refund made. Please only use allocated parking spaces for your property. If the Owner deems the breakdown of adults and children not suitable for that property, they have the right to refuse or cancel the booking.

Garbage - Please ensure that all garbage is removed from your holiday property and placed in the correct coloured bin. Red Bin (General Waste) & Yellow Bin (Recyclables).

Keys & Remote Controls - If lost, you will be responsible for the changing of the locks and the cutting of 3 new sets of keys. Replacement of lost or damaged remotes will be billed at cost to replace, plus 10%. If you lock yourself out after hours and a duplicate set of keys is required please contact the After-Hours Emergency number on 0403 274 966. If no spare keys are available tenants may be liable for any costs involved in gaining entry to premises. If locked out, do not break into or attempt to break into the premises. Any damage caused by same will be incurred by you.

Key pick up - Keys and remotes are in key safes to rear of property on Kidd Lane. You will be advised via email to text the code to the key safe within 48 hours of your arrival.

Returning of Keys - Please return keys via our numbered key safes located to the rear of building.

Toiletries & Linen - Whilst all properties included linen for guests, including sheets & towels, we encourage guests to bring their own beach towels. Unless specifically stated at the time of booking, no other toiletries, amenities, food or drink are provided during your stay.

Cleaning - The premises are to be left in a clean and tidy condition and the washing up of all used cutlery, crockery and utensils must be attended to.

Repairs & Maintenance - In the event of faults and/or malfunctions of appliances or inclusions there is no obligation for the Owner to compensate or discount.

If a tradesperson is called out upon your request to carry out a repair that is found to be unnecessary, the invoice will be charged to you or deducted from the security bond.
All guests are responsible for any loss or damage caused by them to the unit, furnishings or common property during their stay. Costs of additional cleaning, removal of excess garbage, repairs or replacement of items in the property will be deducted from the security bond or charged to your provided credit card, and an administration fee of $50 may apply.
Please respect the Owner’s property. Please do not move items from the property.
All damage, breakages or losses to the property and/or furniture and furnishings caused by guests are to be reported to the owner within 24 hours, and paid for by the guest immediately.
Should you discover a fault or breakage when you arrive, please advise our office immediately or we will deem those the responsibility of the current guest and charge accordingly.
All guests are responsible for keeping the property secure during their stay and upon departure and will be responsible for any theft or damage due to neglect in this area.
All guests are responsible for not causing disturbance to neighbours. No illegal activities are permitted on the premise at any time.

General Clauses - Animals are prohibited. Failure to strictly adhere to this policy will result in an immediate eviction without any refund of monies paid and penalties will be incurred for damage If this is left for our cleaners to attend to an excess cleaning fee of up to $200.00 will be charged. Flea treatments will be charged.

Schoolies bookings cannot be accepted as we do not have the policies, procedures or resources to accommodate for these bookings. If it is reported to us that your booking is for this purpose, you will be required to vacate immediately with no refund of monies paid.

Smoking - Strictly no smoking of any kind is permitted inside, on balconies or within common areas or land at 13 First Avenue. Breach of this policy will incur a cost for the deodorising of all curtains, soft furnishings or any asset which needs cleaning. Excess cleaning due to smoking could be up to $1,500.00

Car Parking - Strictly One car park is available per unit booking.Please email you motor vehicle details including number plate to stay@13firstavenuesawtell.com.au

No liability is accepted for any injury, debt, damage, loss, delay, inconvenience or expense caused directly or by events beyond the Agent or Owner’s control. No responsibility is taken for personal property left on or near the premises. It is recommended that guests take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period. Failure to comply with any of the Agents’ Term of Service can result in immediate eviction without any refund of monies paid. You will also be liable for any costs incurred.

Payment Policy

Payment may be made by debit card or credit card (1.5% fee). If you are unable to pay via online payment, please contact 0403 274 966 direct to discuss alternative arrangements. We are unable to issue keys unless cleared funds are receipted into our account.

For all bookings made direct through 13firstavenuesawtell.com.au, 50% of the tariff is required as a confirmation deposit within 7 days of making the booking. If the booking is made within seven days of arrival the full amount is payable when the booking is made. The balance of all outstanding monies, including the security bond must be paid prior to keys being made available. The balance of payment for all Christmas school holiday bookings is due by 1st December- see below.

For all third-party bookings through sites such as, but not limited to, booking.com, Airbnb, Expedia, payment terms vary and you should consult their individual Terms of Service before proceeding with your booking.

Cancellation Policy

All cancellation and change of date requests must be received in writing, and confirmed via return email.

For all bookings made direct through 13firstavenuesawtell.com.au: If you cancel your accommodation or want to change your dates, and we can secure a replacement booking for the same period and at the same tariff, your deposit will be refunded less a $50 administration fee. If the property cannot be relet, your deposit (and balance if paid) is not refundable.

If you shorten your stay, the unused portion of your rental is not refundable. We retain the right to negotiate the tariff or length of stay to obtain a booking on a cancelled booking as we deem necessary. Please note that a change of booking dates attracts the same conditions as cancellations.

Conditions apply for all third-party bookings through sites such as, but not limited to, Booking.com, Airbnb, Expedia, cancellation policies vary and you should consult their individual Terms of Service before proceeding with your booking.

Please note all Booking.com bookings are non-refundable.

If the of the ownership of the property changes before your holiday, we cannot guarantee that the property will remain available. We cannot accept responsibility for decisions made by a new owner. You will be provided notification as soon as possible, allowing time to organise alternative accommodation.
