Bay Residences is a luxury villa development present in Koh Phangan for more than 10 years.
We are located in Haad Salaad, Haad Tian and in Tong Lang. Our main villa concept, Bay Villas and coming soon Bay Apartment have been designed by Chapman Taylor.
All our villas are build with European quality standards and reply to eco friendly measures to blend into the surroundings they are build into. We took a great care and pride to our customer, to ensure the best stay ever and are here to reply to every need they might have.

Terms & Conditions
GUESTS IN THE VILLA
We do request to see the original passport of ALL guests in the villa, as well as visa entry stamps. Bay Villas declare to local immigration all customers staying with us. In line with this policy, we will automatically decline to check in for customers that are in overstay in the kingdom. Joiners are allowed, within the villa sleeping capacity, however, they need to be declared to Front Office with an ID card, for safety reasons.
It is forbidden to use our managed properties as a business place or to advertise our properties as such without our prior approval.

SECURITY DEPOSIT
We require a security deposit of 15000 THB or 500 USD or 400 EUR or one passport upon arrival. This will be returned upon completion of satisfactory checkout. The deposit is not to be returned until the villa is inspected properly and found to be in the state it was in when the guest arrived. In case of smoking in the house, a standard charge of 2000 THB will be applied. In exceptional circumstances, and at the discretion of our staff this could be raised to 4000 THB if the villa requires specialist cleaning.
Failure to provide this can void the rental agreement between Bay Residence and the customer. Deposits cover house damages and/or any payments for services rendered but unpaid.
A price list for damages is public and available for consultation at reception. Items not included in the inventory replacement price list will need to be priced individually, and our charge will equal the replacement cost + a 20% fee.
Key and/or keychain loss or damage will incur a 2000 THB charge per set of keys.

CHECK-IN/CHECK-OUT
The villa will be available to you by 2 PM on the day of arrival and should be vacated no later than 11 AM on the day of departure. You are required to give us your arrival time at least two days before arrival and give us your time of checkout one day before departure. Without this information, we cannot properly arrange your pick up from the pier or from the villa, which could lead to a delay.

CLEANING
Cleaning in the villa will be provided on a basis of 1 cleaning (including towels & bedsheets change) every 4 days . The check-in day not being counted as 1st day. Cleaning of the dishes is not included in housekeeping duty.

LIMITED LIABILITY
Neither the managing agent nor the owner are responsible for any accidents or injury on the property or related to the use of property facilities. If you notice that any equipment looks faulty and/or unsafe you must inform us as soon as possible. We/the owner accept no responsibility for theft, loss, or damage, of whatever nature, during or as a result of a stay on one of our villas, with our without security on duty as per regular or exceptional schedule. We are not responsible for the defects or putting out of the action of technical equipment on the villa. We/the owner are also not responsible to you for any claims related to the use of locally procured third-party services such as watercraft, water sports, jeep or motorbike rental, or any other services defined as such. We recommend that you take out travel insurance against the risk of accidents. The person in whose name the booking is made acts on behalf of all other persons named, and is liable to the owner for all payments in respect of the booking. The person in whose name the booking is made and those who accompany him or her are jointly and severally responsible for all loss and/or damage which arises for the villa in question and/or any third party as a direct or an indirect consequence of their stay.

NO ILLEGAL SUBSTANCES
We value your privacy and wish for all guests to enjoy their stay. However please note, that we practice a strict no drugs policy. Consumption of illegal drugs of any kind in our villas, inside and outside, is strictly prohibited. In case of visible activity, obvious behaviors, or damages, we will have no choice but to contact law enforcement and provide full cooperation.

PARTIES
In the case of noise complaints from neighboring villas, our staff will issue a maximum of three warnings. If guests fail to comply, a charge of 10000 THB will be applied, and you may be asked to leave.- Villa parties are strictly prohibited.- Any breach of this rule will invalidate the contract and you will be evicted from the property immediately with no refund for outstanding nights. Any evidence of wilful damage to the villa or its contents or the surrounding area will result in immediate police calls and possible prosecution. Guests may invite up to six friends to the villa, but there can be no excessive noise and ALL music must be terminated by midnight.- The tenant is fully responsible for the conduct of all guests both within the villa and whilst on Bay Residence, and as such is liable for any damage caused in these areas by the invited guest/guests. The number of people staying overnight at the villa may only be those confirmed guests at the time of booking.

NO DRONE POLICY
To protect the safety and privacy of our guests, employees and property, Bay Villas prohibits the operation or use of unnamed aerial system or drones without prior approval from the property.

REASONABLE USE POLICY
If water and electricity, are included in your rental price, we ask you to use them consciously and reasonably. Where usage is deemed unreasonable, we will charge you an additional fee commensurate with the amount used that is beyond your Reasonable Use Allowance.
If water and electricity, are included in your rental price, this Reasonable Use Allowance is calculated in the following way: Each bedroom has an allowance of 17KWh of electricity and 250L of water per day. To calculate your overall allowance for your villa, please multiply the per room allowance by the number of bedrooms.
All our villas have meters for electricity and water. In cases of excessive use, we will calculate the excess amount at a rate of 7 THB/KWh and 150 THB/1000L.

MONTHLY RENTALS
In-line with hospitality industry standards a month is defined as 30 nights for booking purposes. We do not discount for any reasons for calendar months with less than 30 days. It is strictly forbidden to sublet our villas.

DEFAULT PAYMENT
In case you cannot honor your outstanding balance for either accommodation or services at the time of settling the bill. We will automatically call the police
and immigration will consider starting a prosecution.

FORCE MAJEURE
We are not liable for failure to perform the contract if the implementation of the agreement is entirely or partially, temporarily, or permanently, prevented due to circumstances that are beyond our control including as a result of fire, flood, earthquake, storm, hurricane, or other natural disasters, civil war, government sanctions or any other disruptions or events outside our control.
Payment Policy
Payment
1. Provisional bookings must be confirmed within 7 days of booking by paying a deposit of a minimum of 50% of the total booking value.
2. The balance of your booking must be received at least 4 weeks prior to your holiday start date.
3. In the case of bookings made within less than 4 weeks of your holiday start date, the full booking cost is due within 7 days of the booking.
Prices
The prices on our website and Online Travel Agencies are not binding. We reserve the right to modify these prices. At the time of booking you will be informed of the final prices applicable. The price stated on the booking confirmation is binding between Bay Villas and the customer.
What is included in the price :
For Nightly Rentals
In the rental price of every villa the following is included:
• All bed linen and towels.
• Use of all kitchen appliances.
• Air-conditioning, water and electricity.
• Use of any on-site leisure facilities.
• Unlimited internet.
• Unlimited TV & Chanel (As per villa specification).
• Unlimited Pool use.
• Cleaning of the villa every 4 days with linen changed at this time (The day after checkin being counted as first day).
• Final clean up on departure.
• Villa management services if needed.
• Villa maintenance services if needed.
What is not included:
• Any excessive cleaning required upon departure (such as upholstery/bed linen towels or rug shampooing etc) or replacement of breakages.
• The cost of repairing or replacing (solely at the owner’s discretion) any item of property which is damaged in the villa or Bay Residence due to negligence or willful default of any guest at the property or for the replacement of any item which is missing.
• The villa is cleaned every 4 days. Upon request, we may be able to arrange for cleaning on a more regular basis but there is an additional charge for this service.
• Cost of transfers of arrival and departure to and of the villa.
For Longer-Term Rentals
• Longer-term rentals include the same amenities and services, but exclude water and electricity rates. These are agreed with the customer prior to check-in.
• The villa is cleaned every 7 days.

The following cancelation policies apply according to the check-in date period.
In case the check-in and check-out dates are on two different cancelation policies. The check-in date policy is the one used for the whole length of the stay.

**Christmas and New Year period with check-in December 20th (Included) to January 10th (Year +1) (Inclusive)**
Until 90 days before check-in (90th day included): Full refund less transfer fee.
From 89 days to 60 days (60th day included): 50% refund less transfer fee.
From 59 days to check-in date: No refund.

**ALL OTHER DATES**
Until 60 days before check-in (60th day included): Full refund less transfer fee.
From 59 days to 45 days (45th day included): 50% refund less transfer fee.
From 44 days to check-in date: No refund.
