Terms & Conditions

Please read our terms and conditions carefully. When making a booking, you accept all booking terms and conditions. It is your responsibility to ensure that all the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of booking.
All persons staying must be declared before the stay, and must be in a provided bed, including babies in cots. No external bedding is allowed without consent from the owners. Children over the age of 1 years are included in the standard rates and refer to children using existing bedding. Additional charges will apply if additional bedding is required. At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is provided by owners. The use of extra beds other than the number booked will attract an additional cost.
During your stay Wi-Fi is provided free of charge for guests staying. Whilst we have good connectivity and good speeds, the connection of the internet is provided by an external agent and cannot be guaranteed during the stay.
Extra cleaning fee will be charged if left in the property is left in a dirty condition. Guests are expected to wash up all dishes and leave kitchen equipment as found at check-in. No pets are permitted in the grounds of the property. Kalinya Estate is a no-smoking property at all times, should cigarette butts be found in the houses or the gardens, a clean-up fee will be charged.
After 10pm all noise is to be kept inside with doors closed. Kalinya Estate is intended for holiday purposes only. We are located in residential area, so parties and gatherings strictly prohibited without prior permission from management. Disturbance to other Soul guests and neighbours including excessive noise and music is prohibited at any time of the day or night, and may result in eviction without refund.
Kalinya Estate does not accept Schoolies reservations. Minimum length of stay restrictions apply to certain rates during special event periods. Rates quoted are in Australian dollars and are subject to change at any time. Rates are inclusive of GST where applicable. Any verbal quote given is an estimate of price only, which is subject to written advice on the booking confirmation.
1. Maximum Occupancy

The maximum number of guests is strictly limited to the number of guests in the Rental Party. An additional charge of $120 per person per night for guests in addition to the Rental Party will be charged. The Guest must not permit other people to enter the Property other than those in the Rental Party stipulated in the Agreement without the prior written consent of the Homeowner.

2. Term

The Agreement begins at Check-In 3pm and Check-Out at 11am. Where availability allows, the Check-in and Check-out times may be varied by agreement between the parties in writing, subject to the payment by the Guest of the applicable additional fee.

3. Minimum Stay

This property requires a 2-night minimum stay. Longer minimum stays are required during holiday periods. If a rental is taken for less than the minimum period, the full cost of the minimum stay period will still apply.

4. Rental Rules

The Guest agrees to abide by the Rental Rules at all times while at the property and shall cause all members of the Rental Party (and anyone else the Guest permits on the property with the written consent of the Homeowner), to abide by the attached Rental Rules and this Agreement all times while at the property.

a. We ask guests to show the utmost care and responsibility as it is expected that the property and furnishings be returned in the exact same condition at the end of a stay as at the beginning. Before booking, please understand that it is a requirement that any damage and/or accidents, unintentional or otherwise, are a responsibility of the Guest and that the Guest will meet these costs, small or large. Where possible, on arrival, we or our caretaker will be there to show you through the Property and can be on hand for your departure.
b. Smoking: Smoking is not allowed inside the Accommodation. Smoking is allowed outside only, but not in or near the spa or pool areas, and only provided that all associated rubbish is removed at the end of the term. Damage from cigarette burns will be charged at full replacement cost to the Guest. Cigarette butts discarded into the gardens may incur an additional charge for cleaning.
c. No visitors or additional guests: People other than those in the Rental Party set out above may not come on to the property or stay overnight in the property. Any person in the property is the sole responsibility of the Guest.
d. Use of Property and Facilities: The property is privately owned. The Homeowner is not responsible for any accidents, injuries, or illness that occurs while on the Property while the Guest or Rental Party is using the property or its facilities, including but not limited to the courts, the pool and the spa. By accepting this booking, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the property and/or facilities or others whom they invite to use the premises. If any additional facilities provided by the Homeowner are used by the Guest or the Rental Party, those additional facilities are also used at their sole risk.
e. Cleaning and departure: Keep the property and all furnishings in good order and in good, clean, ready to rent condition, and only use the premises in a careful and lawful manner. Notify the Homeowner of any breakages or damages as soon as they occur so that they can be resolved for the next guest. The accommodation and its contents must be left in the same clean and tidy condition as on arrival (e.g. dishes washed, all garbage removed, emptying and cleaning of the refrigerator, oven/griller and microwave, cleaning of the BBQ, turning off the lights and appliances including the air conditioning and securing the Property by closing and locking all doors and windows). Electricity and gas are metered and will be verified before and after stay to determine any excessive use which may be charged to the Guest. While the cost of a standard clean is included in the Rental Fee, the Homeowner reserves the right to recover any costs above the standard clean from the Guest following Checkout.
f. Keys and remotes: If keys and/or remotes are lost, the locks may need to be changed or replacements obtained at the Guest’s expense.
g. Pets: Due to the wildlife at the property, Pets are NOT allowed without prior express agreement in writing.
h. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included, daily maid service is not included. Guests are required to provide their own beach towels for use outdoors. We do not permit towels or linens to be taken from the homes to the outdoor areas, such as the pool or the spa. Guests must use the linen provided on the beds, no sleeping bags are permitted for hygiene reasons and every person who is staying must sleep in a bed.
i. Furniture: The Guest must not move any items of furniture from room to room in the Accommodation without written consent of the Homeowner and must replace in its original position any furniture that is moved within rooms. Under no circumstances is any furniture inside the Accommodation to be taken outside the Accommodation onto the grounds of the Property. A fee will be charged should these things occur. Outdoor furniture is also not permitted to be used inside the houses.
j. Pool and Spa/ Hot Tub: No children are permitted in the spa or the pool at any time without adult supervision. When using the spa, remember there are certain health risks associated with these facilities. Use at your own risk. Our housekeepers drain, sanitise, refill and replenish chemicals in the spa prior to your arrival. Do not sit or stand on spa tub covers. Spa tub covers are for insulation purposes only and are not designed to support a person. They will break and you may be charged for replacement. Remember, when not using the spa tub, leave the cover on so the spa will stay warm. No food or glass of any sort is permitted in the pool area or the spa area. Diving is strictly prohibited. Guests are required to provide their own beach towels for use outside. The swimming pool is heated to approximately 26 degrees for guest comfort between October 1st and April 30th. The therapeutic spa is heated to approximately 38 degrees all year round.
k. Water and septic: Kalinya Estate is serviced by an envirocycle system. DO NOT flush anything other than toilet paper. No female products, wipes or baby products should be flushed at any time. If it is found that feminine products or wipes have been flushed and have blocked or damage the septic system, you could be charged damages of up to $2,000 to pump out and repair the system.
l. Garbage: The Guest and the Rental Party shall dispose of all waste material generated during the rental period in the garbage bins located at the front gate, and the bins shall be wheeled out to the street ready for collection if your stay ends on a Sunday.
m. Noise and Quiet Enjoyment: The Property is located in a family-orientated area, offering privacy and tranquility. Excessive noise can be a major cause of complaint. Therefore, no loud partying is allowed. The Guest and the Rental Party shall behave in a civilized manner and shall be good neighbours, respecting the rights of the surrounding property owners. The Guest and/or the Rental Party shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this Agreement and the Guests and the Guest Party shall then immediately vacate the premises in accordance with the party/disturbance procedure below. Quiet hour starts at 11:00 PM on Friday and Saturday nights and 10:00 PM on other nights, after which outdoor noise should be kept to a minimum and loud music, loud televisions and partying that causes excessive noise will not be permitted. There is to be absolutely no music or outdoor noise at all after 12am midnight on a Friday or Saturday night, or after 10pm on any other night. The Guest and Rental Party must in addition comply with all EPA, Council and other laws and regulations relating to noise.
n. Party/Disturbance Procedures: In the event an unsolicited event/party ensues at the Property, or an agreed event creates a nuisance/disturbance (or a complaint from the neighbours is received), then the procedure is as follows:

(a) The Homeowner will phone the Guest first and if the issue is not resolved, attend immediately and attempt to resolve the concern.

(b) If a resolution is not forthcoming, the Homeowner will request immediate vacation of the Property as per this Agreement. If this is met with resistance, the Homeowners will call Private Security (at the Guest’s cost for a minimum of 4 hours for 2x security personnel). Our private security team will secure the premises, safeguard from damage and remain indefinitely or until the property is secure. The Police will also be called and if Council is alerted, further fines to the Guest may arise. By agreeing to these Terms and Conditions you agree to these procedures and all costs.
We are not unreasonable and encourage guests to talk to us if they are concerned. These measures are not designed to prevent our guests from the normal, relaxing use of the accommodation – including controlled, respectful parties – but only to stop those who believe having a noisy, drunken party, late at night, which disturbs the neighbours, is acceptable.
m. Security: We recommend that you lock doors and windows when you are away or sleeping.
o. Fake tan, Sunscreen and makeup: Take care when using these products to remove or to wash off these products prior to sitting on furniture, wiping with the towels and using the linen, as they are impossible to remove from upholstery, linen and towels. We appreciate your cooperation to maintain the high standard for your next visit.
p. Please Note:

a. A breach or indicated breach of any of the above conditions will permit the Homeowner to cancel or amend a booking, refuse access or occupation or immediately terminate the Agreement. Refunds will not be paid on terminated Agreements.

b. As the Accommodation is entire houses and not a hotel with staff, we do not refund for problems such as, but not limited to, plumbing, electrical, television, Wi-Fi not working, light globes out, any appliances or pool/spa not working, blackouts etc. We will endeavour to fix all problems as soon as practically possible, but as the accommodation is entire houses, occasionally a few maintenance issues may arise; most of which are easily fixed. Images on the website are not always an exact representation of the Property as changes can and will occur to keep the property fresh.

c. Failure to comply with the Agreement and the Rental Rules may result in a claim at NCAT, termination of the Agreement, eviction and/or registration with a “bad guest” register and/or reviews on booking sites and will certainly result in loss of Security Deposit.

d. There are new NSW State Government Laws being introduced in regard to Holiday letting and guest behaviour. Please note that if you have complaints made against you or your Rental Party then you may have to appear at a hearing to determine the nature and cause of the complaint., There may be serious penalties involved.

e. Any areas designated as private by the Homeowner are strictly out of bounds.

5. Access

The Guest shall always allow the Homeowner access to the Accommodation for purposes of repair and inspection. The Homeowner shall exercise this right of access in a reasonable manner.

6. Additional Terms and Conditions

At the time of the booking, the Homeowner may set out terms and conditions in addition to those in this Agreement which may include, without limitation, terms relating to pets, the number people permitted to occupy the home, and additional fees or costs which apply to the booking. The Guest agrees to comply with the additional terms, including any terms set out in the site listing the property, as if they were set out in this Agreement.

7. Insurance

Given the strict cancellation policy, we encourage all Guests to purchase travel insurance.

8. Indemnity

The Guest and the Rental Party indemnify and hold harmless the Homeowner against any and all claims for personal injury or property damage or loss arising from use of the property regardless of the nature of the accident, injury or loss. The Guest and the Rental Party expressly recognise that any insurance for property damage or loss which the Homeowner may maintain on the property does not cover the personal property of the Guests, and that Guests should purchase their own insurance if such coverage is desired.

9. Limitation of Liability

The Homeowner’s liability in respect of this Agreement shall be limited to the value of the rental agreed at the time of the booking. In no circumstances will the Homeowner be liable for any consequential damages of any nature, however arising, regardless of whether the Homeowner has been notified of the risk of them.

10. Use of Property

10.1. The Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the accommodation, and that Guests do not intend to make the property a residence or household.

10.2. The Property is to be used for short term residential accommodation only. The Property may not be used for any commercial purpose, wedding, party, gathering or any other function without the Homeowners express written consent.

10.3. The Guest must not use the Property or any part of it for any improper or illegal purpose.

10.4. The Guest must not assign, underlet or part with or share possession of the property without the written consent of the Homeowner.

11. Alterations to Property

The Guest shall not (nor allow others to), make any alterations or additions to the Property or its decorations, fixtures or fittings and the Guest shall not (nor allow others to), remove any of the items specified in the inventory or any of the Homeowners possessions, from the Property. The Inventory means the list of the Homeowners possessions located at or on the Property and/or in the Accommodation.

12. Complaints

12.1. If the Guest is not entirely satisfied with the accommodation, they must immediately contact the Homeowner using the contact details on the bottom of the Rental Rules.

12.2. In the unlikely event that a complaint is not addressed by the Homeowner during the term, the Guest may make their complaint, in writing, to the Homeowner within 14 days after the end of the terms.

13. Lost Property

Valuable items left behind by Guests will be held for the Guest and reasonable efforts will be made to contact the Guest to arrange for return. If items are not claimed for longer than 2 months, they shall become the property of the Homeowner. The Homeowner shall not be held liable for the condition of said items.

14. Termination

Should the Guest or any member of the Rental Party violate any of the terms of this Agreement, including but not limited to the Rental Rules, the Homeowner may terminate the Agreement immediately and the Guest and the Rental Party shall forthwith vacate the Property without refund of any portion of the Rental Rate/Fee. If this occurs, the process that will be followed is set out in the Rental Rules.

Payment Policy

50% of the rental fee is payable at time of booking. The remaining 50% is due 29 days prior to check-in date. Kalinya Estate will accept direct deposit payments or payment by Credit Card (Visa and Mastercard only). 2% credit card fees apply.

Security Deposit- A credit card pre-authorisation of $1000 per stay will be held on all bookings as a bond. This security deposit shall be refunded within 7 days of Checkout, provided no deductions are made due to:

1. Damage to the property or furnishings;
2. Dirt or other mess requiring excessive cleaning;
3. Garbage not being removed;
Missing contents from the accommodation;
4. Excessive electricity, gas or firewood use;
5. Any other cost incurred by the Homeowner due to the Guest’s stay.

If the premises appear dirty or damaged upon check-in, the Guest shall inform the Homeowner immediately.

Cancellation Policy

1. Any cancellation or amendment must be in writing.
2. The Homeowner may refuse to amend a booking once it has been confirmed in writing and any amendment or transfer of the deposit to another booking will be at the sole discretion of the Homeowner.
3. The Homeowner may cancel a booking by notice in writing if the Guest fails to make any payment due under this Agreement, the Rental Rules or additional terms when that payment is due.
4. If the Guest cancels this Agreement more than 29 days prior to the commencement of the Term, the deposit shall be forfeited by the Guest, however, the balance of the Rental Fee will not be payable.
5. If the Guest cancels the Agreement fewer than 30 days prior to the commencement of the Term, the full Rental Fee will remain payable by the Guest and any payment made will be forfeited by the Guest.
6. If the Homeowner cancels this Agreement at any time prior to the commencement of the term the Homeowner will refund the Guest any money paid prior to cancellation.
