Terms & Conditions

By making a booking for a stay at The Barat or staying at The Barat, you agree to be bound by the following terms and conditions. Please read them carefully before you proceed your booking.

[CHECK IN / OUT POLICY]
• Check in Policy: The room is available from 14:00pm. Guest may place luggage at luggage room if arrive early.
• Check out Policy: The room must be vacated by 11:00am. Late checkout is subject to availability and a surcharge of minimum RM100 per hour might apply.

[ROOM ONLY RATE]
• Room Only are room rate base on per room per night basis.
• No meal option or activities are included.
• Price exclude Airport / Land Transfer, Sea Transfer, Kuala Besut Jetty Fees, Tourism Tax (non-Malaysian citizen) & Marine Park Conservation Fund imposed by Malaysia Authorities, unless specified in the booking at the extra item.

[PACKAGE RATE]
• Package Rate are rate base on per person per package basis.
• Inclusion of accommodation at the resort, meal and Snorkeling / Diving vouchers according to package purchased.
• Price exclude Airport / Land Transfer, Sea Transfer, Kuala Besut Jetty Fees, Tourism Tax (non-Malaysian citizen) & Marine Park Conservation Fund imposed by Malaysia Authorities, unless specified in the booking at the extra item.

[SPECIAL REQUEST & SURCHARGE]
• Additional mattress (if can accommodate), a surcharge of RM40 per mattress per night shall apply.
• We will accommodate any special needs you may have to the best of our ability. If you have specific requirements you would like us to consider (e.g. to assist with a disability) please contact the resort at your earliest convenience.
• Additional surcharge might apply per room per night on Public Holidays, School Holiday or Super Peak Season.

[CHILDREN POLICY]
• Children under age of twelve (12) must be accompanied by a parent or guardian all the time.
• Accommodation is free for 1 child under 6 years sharing bed and meals with parents, optional to add on snorkeling trips with children fare applied.
• For Children 6 years old are considered full adult and full rate applied.
• For the safety and comfort of our guests we do implement strict policies regarding the occupancy of our rooms; if the maximum number of guests in the booked room is not adhered to, extra charges will apply on arrival at the property or guest check in may be denied.

【TRANSFER SERVICE】
Land Transfer Service by van:
• Trip from Kota Bharu Airport to Kuala Besut Jetty by van.
• Prebook (at least 2 working days before arrival date) is required.
• Round Trip (min 2 pax) with RM60 per adult / RM40 per child (3-12yrs).
• As land transfer is on sharing basis, there might be waiting time of less than 1 hour in the event there is any flight delay from other arrival guests. Last pick up from Kota Bharu Airport is 15:30pm.
• For returning transfer from Kuala Besut Jetty to KBR Airport, our vans depart Kuala Besut Jetty at 9am, 1pm & 5pm.
• For booking, please email your flight number, arrival date, time, contact no., no of pax (adult / kid age 3-12) to thebaratpp@gmail.com. Our drivers will pickup from airport arrival hall with a signboard. If you miss the signboard, please wait around the Hotlink Counter located at the arrival hall.

Sea Transfer Service by speedboat:
• Trip from Kuala Besut Jetty to The Barat Perhentian Beach Resort by speedboat
• Prebook (at least 2 working days before arrival date) is required.
• Sharing basis & 30mins per trip
• Round Trip with RM60 per adult / RM40 per child (3-12yrs).
• (For prebooked guest) Guest are required report to Barat Jetty Office / Lovely Travels & Tours (located at shop house next to Besut jetty)

• Speedboat Schedule:
In Low Season (Feb, Mar & Oct)
To Island: 9am till 12pm (every hour departure)
Out Island: Depart from Barat resort at 8am & 12pm.
(Guests are required to inform our frontdesk at least one day in advance before departure on preferred speedboat schedule.)

In High Season (April to Sept)
To Island: 9am till 4pm (every hour departure)
Out Island: Depart from Barat Resort at 8am, 10am,12pm & 4pm
(Guests are required to inform our frontdesk at least one day in advance before departure on preferred speedboat schedule.)

• The Barat is not liable for any cancellation of ferry due to weather conditions.

[RESPONSIBILITY]
• For the benefit of all patrons, noise should be kept to minimum at all times. If noise persists, guest will be asked to leave the resort without refund of fees.
• Please keep your room keys with you at all times or deposit your room key at front office drop box when you are out for activities, for security purposes please ensure you lock all doors and windows when leaving your room. Lost or unreturned keys attract a fee of RM 100 per key.
• Room amenities are provided are for guest convenience. Items taken from room as souvenir will be charged accordingly, any items missing from the room after departure will be charge to your credit card or deposit.
• The Hotel reserves the right to charge to you or your credit card provided by you to us or provided by you in online travel agent for any delayed charges incurred after your departure.
• Indemnity concession activity: Guest is aware of the possible risk associated with land & sea sports and activities, and the Hotel will not be responsible for any incident or injury that occurred under the operation of the hotel concession.
• The Hotel shall not be responsible for money, jewellery and/or valuables/belonging left in the room.
• Strictly no cooking whatsoever in any form of food inside hotel rooms and within hotel compound. The management reserve the rights to safe keep any stove, pits, rice/pressure cooker and/or utensils whenever found and to be returned to patrons when check out. A cleaning fee of RM500 will be imposed to your room charge accountable with such activities.
• Management reserved the rights to deny check-ins or guest will be asked to leave the resort without refund of fees.
• Strictly no pets or animal are allow bringing in hotel rooms and within hotel compound.
• The Barat reserve the right to change the rate without prior notice.

【PRIVACY NOTICE】
The Barat Perhentian Sdn Bhd (“The Barat”) regards privacy is of the essence and is committed to protect all Personal Data provided or collected from its Guests, potential Guests or any other parties in the course of The Barat’s commercial dealings or transactions with them. The Barat will endeavour to take all steps necessary to protect and ensure your privacy. This notice among others, involves data collection and use of Personal Data pursuant to the Personal Data Protection Act 2010. We shall make amendments to this notice at any time, if needed, without prior notice and any amendments made will be notified accordingly.

[Personal Data]
Personal Data includes but is not limited to name, age, date of birth, race, religion, gender, ethnicity, nationality, identity card number, passport number and visa information, personal contact information, address, email address, occupation, marital status, employer’s details, income, banking account details, credit card details, charge card details and debit card details of Guests, potential Guests or any other parties, Sensitive Personal Data consisting of information as to the physical or mental health or conditions of a data subject, his or her political opinions, his or her religious beliefs or other beliefs of a similar nature, in either electronic or hardcopy form and where applicable, the Personal Data relating to other persons who may be identified from such Personal Data.

[Purpose]
Personal Data is relevant in all our commercial dealings or transactions involving Guests, potential Guests or any other parties and us. The purpose for maintaining and processing Personal Data among others, includes the following:-
• to maintain a database of Guests for record purposes, internal audit, investigations, for collection of payments and for insurance purposes;
• to participate in any contests or events organised by us;
• to meet the requirements of regulators and comply with all applicable laws, rules and regulations in the sale of the products and services ;
• to supply products and services or for the marketing of such products and services;
• to keep Guests, potential Guests or any other parties informed about launchings of new products and services, customer loyalty programmes, guest membership programmes and conducting of promotional activities;
• to use telephones, mobile phones, sms, emails, social media, letters, notices and our websites to communicate and keep in touch with Guests, potential Guests or any other parties and to manage Guests relationship; and in cases of an emergency.

[Personal Data – How it is obtained]
We collect this information directly or indirectly, from among others, when the Guests, potential Guests or any other parties provide the above details in the course of any purchase of our products and services, through event planners or travel agents, through employers or financial institutions, through promotional activities, customer loyalty programmes, guest membership programs, organising of contests and activities, bookings and registrations conducted online or through any other means Guests, potential Guests or any other parties conduct any commercial dealings or transactions with us. Any Personal Data that you have entered will only be used to communicate with you. You have the choice, at any time, not to provide your personal data or to revoke your consent. However, failure to provide such personal data or revocation of your consent may result in us being unable to provide you with effective and continuous service.

[Disclosure]
All Personal Data including the Personal Data relating to other persons who maybe identified from such Personal Data, provided to us will be kept with the strictest of confidence pursuant to the Personal Data Protection Act. Any divulging of information will be in accordance with the applicable laws and you have hereby deemed to or have consented to or have authorised us to provide Personal Data to the following parties:-
• under applicable laws to any persons or bodies, relevant government agencies, statutory authorities, regulatory bodies and law enforcement agencies;
• third party property management companies, service or product providers, customer loyalty programmes, guest membership programmes, vendors, suppliers and agents or any other parties relevant to the commercial dealings or transactions.

Payment Policy

• All rates stated are quoted in Malaysia Ringgit (RM / MYR).
• Booking must be fully pre-paid and is non-cancellable and non-refundable, should prepayment as per policy not be received prior to arrival, check-in will be denied.
• At all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, stay dates, room types, room rates, and no.of guest). The Barat will not be responsible or liable for errors in booking details.
• Full amount of stay is payable in advance by Paypal, credit card (VISA/Master) at booking time.

With effective from 1st September 2017, there will be a tourism tax of RM10 per room per night for non-Malaysian citizen under Regulation 4, Tourism Tax Regulations 2017.

Cancellation Policy

• Booking must be fully pre-paid and is non-cancellable and non-refundable.
• Any cancellation or date change made 30 days or less before arrival or no show will incur the full reservation charge. In the event of MCO (no interstate travel), paid deposit can be carried forward up to 1 year.
• Failure to arrive at your hotel or property will be treated as a No-Show and no refund will be given (Property policy). For booking through OTAs ( Agoda, Booking.com, Expedia. Ctrips, Traveloka & etc), please refer to respective OTA’s policies.

[Refund Policy]
• No refunds will be given for unused / cancelled stays or services. To request a refund, please contact us through email thebaratpp@gmail.com and subject to the management decision. Any exceptional case will take up to 30 processing days and amount will be refunded via original payment method.
