Waiuta Retreat Terms and Conditions of Temporary Holiday Accommodation
1. DEFINITIONS
“Booking” means the period for which you have paid to stay at the Property.
“Property” means Waiuta Retreat Houliday House Fraser Island and all its fixtures, furniture, fittings and equipment.
“Management or Manager” means the Owner or another person appointed by the Owner (such as a real estate agent), who is responsible for renting the Property.
."Guests" means a person/s who stays overnight in the Property during the term of the occupancy as named in the booking for this term.
“Visitor” means a person a Guest invites or permits to visit the Property during the term of the occupancy who does not stay overnight.
“Holiday Rental” means rental of Property for holiday and other purposes within the maximum term permitted for rental without a residential tenancy agreement under state and territory residential tenancy legislation.
“Dwelling” means a room or suite of rooms occupied or used or so constructed or adapted as to be capable of being occupied or used as a separate domicile.
“Offensive Noise” is as defined under relevant state environmental protection legislation and any local regulations.
“Owner” means the person or entity who owns the Property.
“Property” means the Dwelling and residential premises of Waiuta Retrea Hoilday House.
2. ACCEPTANCE & RESPONSIBILITY.
• Payment constitutes acceptance of these Terms and Conditions.
3. CHECK IN/ OUT
• Check-in time is not before 2pm on the arrival date and check out time is not later than 10am on departure date. Early arrivals, late departures, extra charges will apply.
• Late departure is subject to prior arrangement and availability and extra charges will apply.
• You must notify Management of expected arrival time and a mobile contact number the day before arrival.
• Late checkout delaying cleaners will forfeit the security deposit.
4. PAYMENT
• Bookings are not confirmed unless and until payment is received.
• Payments of the total amount due must be received in Australian dollars net of any bank or other transaction charges.
• Please ensure payments are made within the specified time limits or the Booking will be cancelled automatically without notice or liability to you.
• We accept payment by the following methods: Direct Bank Deposit Payment into our bank account (contact owner), via Little Hotelier.
5. CANCELLATION OR VARIATION
Direct Bank Deposit Payment/ Credit card payment/ Other agreed payment method.
• Your payment and any other fees and charges are non-refundable in the event of a cancellation.
• Cancellation if caused by the client - If Management is able to re-let the Property for the period cancelled the Balance of the rental paid is not refundable unless the house is re-let for the entire period at the same rate. Any shortfall of the booking rate for the entire re-let period will be deducted from any refund due. Management will free the dates to re-let and possibly offer discounted rates in an effort to re-let.
• Any variation of the Booking which reduces the number of nights stay will be treated as a cancellation of the Booking in respect of those nights. No refund is due if the property cannot be re-let.
• If a refund is made due to the property being re-let then a $200 cancellation fee will apply plus, less administration charges, commissions, difference of rate and expenses.
• Should you be eligible for a refund it will be made through bank deposit into your bank or Credit Card refund with 14 days of the new (re-let) Booking full payment. Refund method to be decided by owner.
• A variation of the Booking which reduces the number of nights stay will be a treated as a cancellation of the Booking in respect of those nights.
• An administration charge of $150 will be charged for any variation of the booking.
• Waiuta Retreat have a minimum nights stay policy. No refund will be made for a variation to the extent that it breaches our minimum nights stay policy.
• If you wish to vary or cancel your Booking, please contact us immediately at stay@waiuta-retreat.com.au
6. SECURITY BOND
• A security bond payment of $500 is required and due one week prior to the guests arrival. It will be credited to your nominated bank account or refund back to a Credit card (as determined by the owner) once our property has been inspected and deemed left in a similar state to your arrival.
• Any damage, loss or expense incurred by Management as a result of the Guests breach of these Terms & Conditions will be charged against the bond. Examples of this include but are not limited to any breakage, damage or excess cleaning requirements, extra guests beyond those declared.
7. UNAVAILABILITY
• If the Property becomes unavailable for the Guests occupancy due to unforeseen circumstances then Management will inform the Guest immediately and endeavour to obtain suitable alternative accommodation on Fraser Island for your occupancy; failing which any moneys paid will be refunded in full. Management will not be liable for any losses or additional costs etc. associated with alternate accommodation having to be sort by the client due to these unforeseen circumstances.
8. PARTIES, FUNCTIONS AND ADDITIONAL GUESTS.
• Parties and Functions are strictly prohibited.
• Waiuta Retreat does not allow additional guests and must not be used as gathering location. No persons, other than the nominated, number of guests booked for your stay, are permitted to enter the premises.
• Only the guests nominated and agreed in the Booking may stay in the Property overnight. If any other guests stay, management reserve the right at their sole discretion to apply extra charges, forfeit your security deposit/bond, or the booking may be terminated without refund and guests asked to leave the premises immediately and no refund will be due.
• Should the owner become aware of this breach in terms, Guests forfeit their security deposit.
• Security cameras are in operation at the premises and any suspicion or notification of a breach of these terms will be verified by viewing security footage to determine any breach.
9. LINEN AND TOWELS
• Waiuta Retreat supply linen, pillows, blankets and towels. Pillows and blankets must be left where supplied in the bedrooms and linen and towels placed in the tubs provided at the washing machine on departure. Beach towels and porta-cot linen are not included. Beach towels are available on request, a $30 fee for additional washing will apply.
10. PETS
• Pets are not allowed at the Property and prohibited on Fraser Island.
11. YOUR OTHER RESPONSIBILITIES
• You must comply with all instructions from Management and the caretakers of the Property concerning occupancy, the property, health, safety and quiet enjoyment of the Property and not disturb our neighbours.
• You are responsible for damage, breakages, theft and loss of the Property and any part of it during your stay. You must notify us of this immediately. Management may recover for any repair or replacement cost (at Management's discretion) from the security deposit and charge visa or invoice for costs.
• Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses incurred.
• Before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, and crockery and cutlery washed and packed away. The Property must be left in a clean and tidy condition, as it was found.
• Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc. which will be deducted from the security bond or charged to your credit card.
• All furniture and furnishings must be left in the position they were in when you arrived. Should the furniture have been moved you will be charged additional costs for returning items to original location which will be deducted from the security bond or charged to your credit card (at Management's discretion).
• The property should be vacated on time and secured. All windows and doors are to be locked. All keys must be returned to Management or as otherwise directed.
• You are responsible for the safekeeping and replacement of accommodation keys. Duplicate keys will be provided at an additional charge of $200 administration fee plus cost of duplicate keys.
• Smoking is not permitted in the Property. Smokers to smoke away from open windows and doors, any odours or evidence of smoking in the property will forfeit the Security Bond in full (the presence of the effects of smoking at Management's discretion).
12. REPAIRS, REPORTED PROBLEMS
• Given remote location of the Property, reliance on barges, availability of contractors, parts, and all other associated circumstance, management cannot guarantee that a reported mechanical, electrical, or any other issue related to the property’s operation will be addressed within the duration of the Guests stay.
• Management cannot guarantee full mechanical, electrical, or any other items related to the operation the property will be in operation on the arrival of the Guests or for the duration of their stay.
• Problems reported to Management by guests (such as air conditioning, refrigerator, or washing machine not working) and investigated, and the problem deemed to be the failure of the guests correct operation (or other), expenses incurred to address the reported issue shall be recovered by management and deducted from the guests security deposit.
13. PROBLEMS OR COMPLAINTS
• In the case of any problem or complaint, you must inform Management at the earliest opportunity so Management has the chance to try to rectify the situation. You must allow repair/service access to the property during reasonable hours. Call 0419 722 098.
• Any complaint, which cannot be resolved locally, must be notified in writing to Management prior to departure from the Property.
• Failure to follow this procedure may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.
• We recommend all guests purchase travel insurance since Management are not responsible for any injuries, illness or accidents that may occur whilst staying at our property.
