BOOKING TERMS AND CONDITIONS

The following terms and conditions apply to your stay at White Hut on Golflinks. These terms and conditions may be updated from time to time and are subject to change at our complete discretion without further notice to you.

DEFINITIONS

“the property” means the property for holiday rental located at 118 Golflinks Road, Kingston SE SA 5275

“Guest, you” means the person named in the booking and the person/s considered to be booked in as a guest within the total of number of guests booked.

“White Hut on Golflinks, we, our or us” means SA & JM Gluyas, ABN 66 328 146 371

“Child” or “Children” means a person or persons aged between 2 years and 17 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged 18 years or over.

“Costs Schedule” means additional fees and charges associated with the repair or replacement due to the inappropriate use of or damage to the property.

ACCEPTANCE
By completing the booking, the guest will be deemed to have accepted these terms and conditions and acknowledge that these terms and conditions is subject to any current and future COVID-19 legislative provisions enforced by the South Australian or Federal Government of Australia.

BOOKINGS
Bookings can be made via our online booking button. Reservations are subject to available and actual pricing at the time of booking.

By using our online booking system ‘little hotelier’, you agree to their terms and conditions available at https://www.littlehotelier.com/. All bookings must be guaranteed at the time of reservation by way of a 50% deposit. You authorise White Hut on Golflinks to charge the cost of your booking to the credit card in accordance to the payment schedule detailed below. All bookings will be confirmed by email.

PERSONAL DATA & PRIVACY
We agree to comply with the Privacy Policy, the Privacy Act 1988 and all other applicable privacy laws and such other data protection laws as may be in force from time to time which regulate the collection, storage, use, and disclosure of information about identifiable individuals (Personal Information) held by or on behalf of the Guest to the extent that they are legally obligated to comply with these laws.

You consent to providing your personal data. You agree that all information you provide to us is true, accurate and current. You agree that you are responsible for all information that you submit to us. If we believe that any information provided to us by you is false, misleading our inaccurate, we may, at our sole discretion, terminate or cancel our services with you.

RATES
All rates quoted are in Australian dollars, inclusive of GST and are subject to change at any time. Any verbal quote given is an estimate only of price, which will be subject to written advice on confirmation of the booking.

Minimum rates are for the sole occupancy of the property and includes 2 guests, additional rates apply for extra guests.

LENGTH OF STAY
There is a standard two-night minimum stay during Off Peak (May – September) and a standard three night minimum during Peak (School Holidays and Long Weekends from October-April) Minimum length of stay restrictions apply to certain rates.

Enquiries relating to one-night stays may be considered, however are subject to availability and are considered at our sole discretion.

CHECK-IN AND CHECK-OUT
Standard check-in time is 2:00pm on the day of arrival. Standard check-out time is 10:00am on the day of departure. Late checkouts may be available upon request, however, are subject to availability and our sole discretion.

NUMBER OF GUESTS
White Hut on Golflinks sleeps up to eight (8) guests, with a maximum of two (2) guests per room, with the exception of a porta cot (not supplied). At no time during the booking shall the number of guests exceed the number of guests booked.

CHILDREN & UNACCOMPANIED MINORS
All guests under the age of 18 must be accompanied by a parent /guardian. As the parents, guardians or chaperones of children you are personally and legally responsible and must supervise them at all times. We accept no responsibility for any children staying or visiting the property

RELOCATION
In the event of a situation whereby White Hut on Golflinks cannot provide accommodation as previously confirmed for whatever reason, we will undertake to relocate guests to a comparable alternate property at its absolute discretion with no additional cost to the guest, if available. Should the guest wish to choose a property of higher standard other than offered, under this condition the guest will be required to pay any price difference. Should the guest not wish to accept the relocation a full refund & booking cancellation may be granted.

INSURANCE
White Hut on Golflinks strongly recommends that guests purchase comprehensive travel insurance.

THE PROPERTY

SMOKING
White Hut on Golflinks is a non-smoking property. We do not permit smoking of any substances, inside the property including but not limited to tobacco, marijuana, illegal drugs, e-cigarettes, vape pens, vaping and cigars. A fee of $250 plus any additional cleaning costs will be charged where there is evidence of smoking within the property, such as traces of residual smoke, anywhere except the designated are outside, in accordance with the Cost Schedule.

SECURITY
To prevent theft of or damage to furnishings or guest’s personal project, guests must close and lock doors and windows at check-out and when the guest is not present at the property Guests must contact White Hut on Golflinks immediately where they are not able to secure the property.

PETS
With the exception of Sight and Hearing assistance dogs, ALL pets are strictly forbidden. Any guests breaching this rule will face immediate eviction without refund and a cleaning fee in accordance with the Cost Schedule.

SHOES
Shoes are not to be worn in the main property. Shoes are requested to be left in the alfresco are or the garage before entering the main property.

NOISE & PARTIES
You acknowledge that parties and gatherings are strictly prohibited at the property without prior permission from us, and that all noise shall be kept indoors after 10pm and prior to 8am. Excessive noise, music and any other form of disturbance to neighbours is prohibited at all times and may result in an eviction without refund. Additionally, where we or the police attends the property to deal with noise complaints or excess guests, or where a complaint has been received during or after your stay, you will be charged a fine in accordance with the costs schedule. Evidence of a party or function found after the guests have checked out shall result in an additional charge.

A ‘good neighbour’ policy shall be enforced. You acknowledge that White Hut on Golflinks will be treated with as much care as your own residence, and that it shall be left in the same condition as when you arrived. Behaviour exhibited by guests that is disrespectful of and disruptive to neighbours or the community, or which prompts complaints to us from the police, local council or neighbours shall not be tolerated and may result in a fine or eviction.

PROPERTY DAMAGES OR LOSS
The guest acknowledges failing to adhere to their obligations or any terms and conditions may result in fees as outlined in the costs schedule.

All damages, breakages or losses to the property, furniture and furnishing are to be reported immediately. To avoid being charged for any damage not caused by the guest, such faults or breakages should be brought to our attention immediately following check-in.

The guest's credit card details are kept for seven (70 days after check-out. A final inventory, inspection and assessment of the property will be completed after check-out. The guest authorises White Hut on Golflinks to charge the guest's credit card for any fees associated with the cost of repair or replacement of property, in accordance with the costs schedule and at our sole discretion upon determination, however, we will provide communication to the guest upon determination.

GUEST OBLIGATIONS
The Guest agrees:
• to follow all government guidelines, law enforcement regulations and health authority regulations, as applicable during the booking.
• to be an occupant of the property for the entire duration of the stay
• not to sublet or allow unregistered guests to stay at the property
• to comply with all applicable laws and regulations
• to co-operate with White Hut on Golflinks and abide by these terms and conditions during their stay at the property
• not to use the property for any purpose other than the approved purpose as set out in these terms and conditions
• not to use the property for any criminal activity, including online, and acknowledges White Hut on Golflinks will cooperate with any investigation of alleged criminal activity at the property during or after the stay
• not to use the property for parties and gatherings without prior written permission
• to not have pets on the property
• to abide by all of the terms and conditions.
• to leave the property in the same condition as found, returning all furniture and styling pieces to their original location
• not to nail, screw, staple or fix anything to any wall, door or other surface or part of the property.

GUEST FACILITIES
• The guest must contact us immediately with the 24 hour emergency contact number, in the event of an emergency.
• Free internet connection is available to all guests. The connection of the internet during the booking is not guaranteed and may be disrupted or unavailable without notice.
• Under no circumstances are motorbikes, dirt bikes, quad bikes, use of firearms or air rifles, fireworks allowed on the property premises.
• All sporting and leisure equipment that is available to use at the property must be securely stored and returned in the same condition. Lost, stolen or damaged goods will incur costs in accordance with the Costs Schedule
• It is the responsibility of the Guest to ensure that any third parties engaged to provide services at the property, including but not limited to caterers, beauticians and massage therapists, are informed of these terms and conditions, and hold appropriate Public Liability insurances. White Hut on Golflinks accepts no liability for any third-party services, including those which may have been recommended or referred by us.
• All personal property left behind is the sole responsibility of the guest who must either arrange payment for post or delivery or collect the item from the property.
• The guest acknowledges the property may be visited by wildlife including, but not limited to rodents, insects, cockroaches, kangaroos, snakes and spiders, and agrees White Hut on Golflinks is not responsible for the natural and surrounding habitat.
• White Hut on Golflinks does not accept liability or loss caused by failure of equipment and/or services out of our control, including, but not limited to, water, electricity, gas and internet. In the event of a failure, the guest should notify us in the first instance. Any problems that arise during the booking period that do not constitute an emergency as determined by us, will be remedied at any time during or after the booking period, at our sole discretion. White Hut on Golflinks reserves the right to enter the property at any time, without notice, to protect and/or undertake maintenance of the property. We will give notice to the guest wherever possible.

REVIEWS AND SOCIAL MEDIA
We encourage our Guests to tag @whitehutongolflinks when posting during their stay at the property, and unless you explicitly object, we may tag you in some of our posts on matters of interest or repost your images on our accounts.

Where, upon request, you provide us with images of you or others, taken during your stay at the property, unless you explicitly object, you agree that you have permission to use the images and to release and hold us harmless for any liability in relation to the images which we may use for our marketing material or for promotional purposes.

Guests agree testimonials we have received from other guests are only indicative of that guest’s experience at the property. You recognise and agree these are not a guarantee of the experience you will have at the property; however, we will do our best to ensure every guest is satisfied and has a memorable stay.

In the event you experience any issues or problems during your stay, you agree to give White Hut on Golflinks the opportunity to rectify the situation prior to leaving negative reviews that may be published in the public domain, and which may be damaging to our reputation.

ASSUMPTION OF RISK
You agree to be responsible for any damage to the property or equipment which you may cause due to negligence. You hereby waive and release, indemnify, hold harmless and forever discharge White Hut on Golflinks and its agents, directors of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that you ever had or may have, arising from or in any way related to your usage of and/or stay at the property, or any activities that you may have partaken in on the premises of White Hut on Golflinks, provided that this waive of liability does not apply to any acts of gross negligence, intentional or wilful misconduct. You assume any risk, and take full responsibility and waive and release us of personal injury; infection, illness (including but not limited to contracting or spreading Covid-19), death, damage for injury, including personal injury and death, damage, or loss of personal Property, losses of any kind whatsoever arising out of, attributable to cause by, or resulting from your booking and or stay, associated with White Hut on Golflinks, including but not limited to using the property in any manner, form or fashion, and participating and/or engaging in any activities on and off the premises.

LIMITATION OF LIABILITY
To the fullest extent permitted by law (and to the extent permitted under Australian Consumer Law), the total liability of White Hut on Golflinks under or in connection these terms and conditions in respect of all Claims (if any) is limited to the fees paid or payable for the booking and in any event, will never exceed the available proceeds of the professional indemnity and/or public liability insurance coverage of White Hut on Golflinks (as varied from time to time) or the fees paid to White Hut on Golflinks by the guest, whichever is the lesser amount.

In no case shall White Hut on Golflinks, its officers, affiliates, agents, contractors, or licensors be liable for any Consequential Loss arising from the guest’s use of, or reliance on the services, the website and/or content or information (including regulatory or legislative) provided in the property or in information brochures in the property including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the services, even if advised of their possibility.

AUSTRALIAN CONSUMER LAW
Further, nothing in these terms and conditions are intended to limit any Australian Consumer Law guarantees or warranties that may apply to the services and that cannot be excluded.

DISPUTE RESOLUTION
If a dispute arises out of or relates to these terms and conditions, a party must not commence any court or other proceedings relating to the dispute unless it has first issued a written notice to the other party specifying the nature of the dispute. Upon receipt of the notice by the other party, the parties must endeavour to resolve the dispute within twenty-one (21) days using informal dispute resolution techniques including settlement discussions and mediation. If the dispute cannot be resolved, then the parties shall be free to pursue any right or remedy available to them under applicable law. Nothing in these terms and conditions will prejudice the right of a party to institute proceedings to enforce payment due under these terms and conditions or to seek urgent injunctive or declaratory relief in respect of a dispute or any matter arising under these terms and conditions.

ENFORCEMENT OF TERMS AND CONDITIONS
Upon booking the property. You agree that your access to and use of the property is subject to these terms and conditions. Failure to adhere to the obligations set out in these terms and conditions at any time before or during your stay may result in the total charge of the reserved booking and your stay/remainder of your stay cancelled.

If any provision or part of these terms and conditions are void or unenforceable for any reason, then that provision or part will be severed from these terms and conditions and the rest of the terms and conditions shall be read as far as possible as if the severed provision or part had never existed.

GOVERNING LAW AND JURISDICTION
These terms and conditions are governed by the laws applicable in the state of South Australia and the parties agree to irrevocably submit to the exclusive jurisdiction of the courts of that State.

Payment Policy

PAYMENT
50% charged at the time of booking. The remaining 50% is charged 14 days prior to arrival. The guest’s authorises White Hut on Golflinks to charge the credit card provided at booking for these payments. If you are booking within 14 days of your arrival, 50% charged when booking, the remainder 50% charged will be completed within 48 hours.

Cancellation Policy

CANCELLATIONS & REFUNDS
Guests can cancel their booking 48 hours after booking confirmation and receive a full refund of monies received. Cancellations after this time will incur a cancellation fee equivalent to the details below.

OFF PEAK (May – September)
• Cancellations received with greater than 7 days notice prior to arrival will receive a refund of all monies received.
• Cancellations with less than within 7 days of arrival unless another booking can be secured will surrender all monies received.

PEAK (School Holidays and Long Weekends from October-April)
• Cancellations received with greater than 14 days notice prior to arrival will receive a full refund of all monies received.
• Cancellations with less than within 14 days of arrival unless another booking can be secured will surrender all monies received.

No Cancellations are accepted on the day of arrival or after check-in. The guest will be charged the total of the reserved booking.

A booking can be rescheduled with no cancellation fee, provided 30 days notice has been given. The new booking date must be within 12 months from the original booking date. Rates may be subject to increase after your original booking or due to different tariffs; where this occurs, the guest may be required to pay the difference.

If a situation arises due to, but not limited to, force majeure (any act, circumstance or omission over which we could not reasonably have exercised control), terrorism, natural disasters, pandemics, political instability, or other external events making it unviable for us to uphold the booking a booking may be cancelled. Where the original booking has been varied or cancelled, we will do our best to provide an alternative that is substantially the same or as similar as practical to the original booking.

We reserve the right to cancel or modify bookings where it appears that a guest has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the booking contains or resulted from a mistake or error. We reserve the right to cancel or amend bookings if they do not adhere to our terms & conditions.
